竞拍百万房屋要交40万税费 竞买人要求拍卖公司承担

京华时报讯(记者裴晓兰)张某在房产拍卖会上拍得一套价款104万元的房屋,后在办手续时被告知需交纳40余万元税费才能过户。认为拍卖协议显失公平,他要求拍卖公司承担该笔税费。近日,通州法院受理了此案。

2012年1月1日,张某与北京一家拍卖公司签订一份《竞买登记签约单》,约定参加该公司在通州区举办的潞城镇潞城新村一处房屋的专场拍卖会。

随后,张某与拍卖公司签订《拍卖成交确认书》,成交的拍卖物为一套面积为105平方米的房屋,总价款104万元,并规定该房产所拖欠的供热费、水电费及物业费等由买受人承担;房产产权过户所需的相关税费均由买受人承担。

张某说,他将房款104万元给付拍卖公司,后在办理过户手续时发现,由于该房屋登记在山东省农业银行某支行名下,且登记未满五年,房屋过户需要交纳营业税、土地增值税、企业所得税、契税、印花税以及物业费、供暖费等40余万元。

张某随后以《拍卖成交确认书》中关于相关税费负担的约定显失公平为由,起诉要求拍卖公司承担上述费用。但拍卖公司对此不同意。

目前,此案正在进一步审理中。
